Terms & Conditions

It’s never the most interesting bit I know, but it’s really important that you’re comfortable with who will be able to see your images once we’ve captured them together.  So below you’ll find a copy of my standard terms and conditions and I’ll summarise the key points here for ease:

  • The copyright to your images is owned by eyehart Photography.
  • I will never sell your images or use them for any purposes outside of marketing eyehart Photography.
  • Social media is really important to me so you’ll be provided with a lower resolution set of images that you can use on social media (Facebook, Pinterest etc) with my logo on & the fabulous high resolution ones that will look amazing printed and hanging on your wall.
  • I’m happy to travel to a location of your choice in the UK. Locations within 10 miles of north Leeds are included in the package price. For travel further afield please contact me to confirm travel costs.

You’ll receive a full set of these terms and conditions to read and sign before our shoot but do get in touch if you have any questions about them in advance.

  1. A Summary of the Contract

The photographer is responsible for providing for the client a photographic service and products as detailed in section 2 (‘coverage’).

The client undertakes to engage the photographer for this coverage for the price as detailed in section 3.

  1. The Coverage

Coverage will be provided by the photographer as written by you in your booking form and agreed by both parties. If no form is received, your photographer has the right to decide when coverage will commence.

  1. Payment Arrangements

The client will pay the photographer the total fee agreed subject to the following terms:

A £50 deposit to secure the date and payable on execution of this agreement. This deposit is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.

Cancellation less than 4 weeks before the date of the photoshoot will require payment in full. All cancellations must be in writing.

Payment can be accepted by the following methods: BACS, Cash or Cheque.

Any additional payments for extra albums and other services are to be made when that order is placed.

  1. Copyright

The entire copyright in the photographs is retained by the photographer at all times throughout the world. You or any third party may not alter or adjust the images in anyway unless written consent is given by the owner of copyright to those images. Where digital media via download/disc/USB of photographs has been provided to the client(s) as part of their family photo shoot collection, these photographs may be printed for personal but not commercial use.

Images are provided that are enhanced for online/social media use with eyehart Photography’s logo printed underneath the images. Please only use these images on the web for the protection of copyright. They also provide faster upload speeds and are pre-sharpened for computer screens to show them at their best!

The photographer retains the right in all cases to use the photographs in any manner at any time and in any part of the world for the purposes of advertising or otherwise promoting her work. Generally eyehart Photography will set up a series of “Sneak peeks” on facebook and Instagram prior to images being presented to yourselves. You may tag yourselves in these images to share with family and friends.

  1. Image Size, Colour, Style and Composition

All image sizes are approximate. The photographer will provide a pleasing colour balance but cannot guarantee exact colour matching.

It is sometimes not possible to record on film or in print the exact colour as seen by the human eye. Images presented digitally can vary in colour and quality vastly depending on the monitor/device used to view them, therefore the quality of edit for the digital form cannot be rejected on the basis of viewing them from another device other than the photographers own. There is no right to reject on the basis of style or composition. eyehart Photography predominately makes use of natural light, if your venue is in a dark environment, your images may result in a grain effect, especially when flash is not permitted. This can be very desirable and is not a fault of the camera. If you do not want grain, please make sure it is suitable before booking that a flash may be used in the venue.

  1. Turnaround

Where digital images have been ordered, each individual image is checked, adjusted and edited.

The turnaround for the completion and delivery of these images is at the photographers discretion. As the photographer may think it appropriate to add a filter or special effect to the images. Also, if there is bad weather or the images were taken in a dark venue, extra time is taken to brighten and reduce noise of images.

  1. Digital Media

Digital images are delivered on download and will be at two resolutions; medium resolution, colour corrected with eyehart photography’s logo suitable for social media usage and high resolution, colour corrected suitable for printing.

Images are generally delivered at medium resolution to aid loading speeds due to the large amount of files.

You will receive a password via email which will provide access to your gallery to view and purchase images.

  1. Attendance

In the unlikely event the photographer is unable to complete the coverage due to unforeseen circumstances, the photographer reserves the right to appoint another photographer to attend on his behalf to undertake the photography. If such a situation arises, eyehart Photography cannot be held responsible for the work undertaken by the new appointed photographer.

  1. Indemnity

The photographer agrees to indemnify the client against all expenses, damages, claims and legal costs arising out of any failure by the photographer to obtain any clearances for which he was responsible in respect of third party copyright works, trade marks, designs or other intellectual property. The photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the photoshoot. In all other cases the client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.

  1. Limitation of liability

In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. The undersigned have read and understood the above contract and agree to the terms and conditions in their entirety.
